The cannabis industry has gotten good at managing risk. What gets talked about far less is how operators manage the cost of carrying it. For CHNANY member Daniel Guiney, Principal at ZRM Brokerage, one of the most overlooked decisions a cannabis business makes is how it pays for that coverage in the first place.

"Cannabis is a cash business, and a big insurance premium can tie up a lot of that cash at once," Guiney says. "Premium financing is one of the simplest ways to take that pressure off without lowering your coverage to do it."

Most cannabis insurance is written in the surplus lines market, and those carriers usually want the full annual premium paid at binding. For a cultivator, manufacturer, or retailer with several locations, that bill climbs quickly once you add up property, general liability, product liability, equipment breakdown, and workers' comp. It can land anywhere from the low tens of thousands to well into six figures. Most operators then have to pay it in cash, because federal illegality keeps them out of the ordinary bank loans and credit lines other businesses would use to spread a cost like that.

Premium financing offers a way around that. A licensed finance company pays the full premium to the carrier up front, and the business pays the finance company back over the life of the policy. That usually means a down payment of somewhere between ten and twenty-five percent, then nine to eleven fixed monthly payments. It is a separate loan, not a change to the policy itself, and every number is laid out before the client signs anything.

There is one detail here that comes up constantly in cannabis. The collateral behind a premium finance loan is the unearned premium, meaning the part the carrier would give back if the policy were canceled partway through for non-payment. If a premium is fully earned the moment it binds, there is nothing for the lender to recover, so as a rule it cannot be financed. Cannabis policies also tend to carry a minimum earned premium, often 25 percent or more, which pushes the required down payment up, since it has to cover whatever portion of the premium is non-refundable. "None of that is a reason to skip financing," Guiney says. "You just have to set it up around how the policy earns, which is part of what a broker who knows this space should be doing for you."

The main reason operators do it is cash flow. Instead of one large payment at the start of the year, the cost becomes a set monthly figure, and the money that would have gone to the carrier stays in the business for payroll, inventory, or whatever comes next. It also makes the year easier to budget, and several policies can often be combined into one payment. Just as important, it takes away the most common reason operators end up underinsured. "When the whole premium is due at once, people start looking at where they can trim limits to bring the price down," Guiney notes. "In this industry you usually need higher limits than the base policy gives you, so that is a bad place to cut. Financing means cash flow is no longer the reason to carry less coverage than you should."

None of this makes it free money, and Guiney is upfront about that. The policy is what secures the loan, so missing payments can get the coverage canceled, and in cannabis a gap in coverage can cause bigger problems than the premium ever would, from compliance issues to a violation of the lease. His advice is to work with an established, licensed finance company on fair terms, and to treat the monthly payment as seriously as any other bill the business has to cover.

For Guiney, it comes back to something he repeats to most clients. Putting the right coverage in place only helps if the business can keep paying for it.
